Article I: Sec. 4. RELIGIOUS TESTS. No religious test shall ever be required as a qualification to any office, or public trust, in this State; nor shall any one be excluded from holding office on account of his religious sentiments, provided he acknowledge the existence of a Supreme Being.
Thats right ladies and gentelmen, according to the Texas constitution, atheists can't hold office in Texas. Sadly, I think the ACLU would have something to say if we actually enforced it..... but still, it remains. That goes to show you what the Establishment Cluase was really about when the Constitution was drafted. Not to prevent any Religions in any government(National, state, or local) in the US, but to protect the right of each state to have it's own religious beliefs. When the US Constitution was being prepared to sign, a few of the states, having a state religion, were afraid that the American Government would instate a State religion that differed from there own. Thus, the Establishment clause was added to ensure there would be no such action. Unfortunantly, due to the XIV Amendment, states lost the right to have a clear cut religion. Ohh well, you win some, you lose some.
